AG Opinion: Localities May Ban Fracking

Via friend of the blog Senator Roger Manno comes word of a new attorney general opinion indicating that even if state law allows for fracking, local governments may, in certain circumstances, have the right to ban fracking as part of their zoning power. Sandra Brantley, counsel to the General Assembly, wrote a three page letter which concludes as follows:

[I]t is my view that it may be possible, under current law as well as the proposed regulations, for a local government to ban hydraulic fracturing in that jurisdiction.
